At times during the administration of a Trust the named Trustee(s) will become unavailable or wish to resign. Absent provision in the Trust for appointment of a Successor Trustee, it may be necessary to apply to the Court for appointment of a Successor Trustee. Often times, when making such application to the Court, a reformation to provide for future appointment of a Successor Trustee is sought at the same time, to avoid future need for application to the Court.
