Similar to Will contests, described above, when an interested person believes that a Trust was procured by fraud or undue influence, or if the Trust was not properly executed, litigation may be required to determine whether the Trust is valid. Named beneficiaries are often served with documents which limit their time to respond, and, failing to respond lose their ability to contest the trust.
