If a decedent fails to leave the surviving spouse assets valued at  a minimum of thirty percent (30%) of the elective estate (as defined by statute), the surviving spouse can obtain judgment for the full elective estate.  At times this judgment has to be satisfied from assets which have passed outside of the estate and are in the possession of the third parties.
